1. Acceptance of Terms

By accessing or using ICAN-B Academy (“the Platform”), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Platform. These terms apply to all users, including visitors, registered users, and course purchasers.

2. About the Platform

ICAN-B Academy is an online learning platform operated by ICAN-B, offering courses related to Applied Behavior Analysis (ABA) therapy for behavior analysts, Registered Behavior Technicians (RBTs), parents, and caregivers.

3. Eligibility

You must be at least 18 years of age to create an account and purchase courses. By using the Platform, you represent that you meet this requirement.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at inquiry@ican-b.com if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

5. Course Purchases and Payments

• All course purchases are processed securely through Stripe.
• Prices are displayed in US Dollars (USD) and are subject to change without prior notice.
• By completing a purchase, you agree to Stripe’s Terms of Service.
• Access to purchased courses is granted immediately upon successful payment confirmation.

6. Refund Policy

• Refund requests must be submitted within 7 days of purchase to inquiry@ican-b.com.
• Refunds will not be issued after 7 days or if more than 30% of the course content has been accessed.
• Approved refunds will be processed within 5–10 business days to the original payment method.
• ICAN-B Academy reserves the right to evaluate refund requests on a case-by-case basis.

7. Intellectual Property

• All course content, including videos, materials, assessments, and text, is the exclusive property of ICAN-B Academy and its licensors.
• You are granted a limited, non-exclusive, non-transferable license to access and use purchased course content for personal, non-commercial purposes only.
• You may not reproduce, distribute, publicly display, modify, or sell any content from the Platform without prior written consent.
• Unauthorized use of our intellectual property may result in legal action.

8. Acceptable Use

You agree not to:

• Share your account credentials or purchased course access with others.
• Attempt to reverse-engineer, copy, or redistribute course content.
• Use the Platform for any unlawful purpose.
• Disrupt or interfere with the Platform’s security or functionality.
• Impersonate another user or ICAN-B Academy staff.

9. Third-Party Services

The Platform integrates with third-party services including:

• Google and Facebook for social sign-in (subject to their respective privacy policies).
• Stripe for payment processing.

ICAN-B Academy is not responsible for the practices of these third-party services.

10. Disclaimer of Warranties

The Platform and its content are provided “as is” without warranties of any kind, express or implied. ICAN-B Academy does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Course content is intended for educational purposes only and does not constitute clinical advice, supervision, or a substitute for professional training as required by the BACB or any other certifying body.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ICAN-B Academy shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Platform, even if advised of the possibility of such damages.

12. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion.

13. Modifications to Terms

ICAN-B Academy may update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Los Angeles County, California.
